The Russian government has made to the State Duma a draft law designed to protect the interests of investors, the imposition of criminal liability for violations of the securities market, the "Prime-TASS."
Experience has shown that bringing offenders to administrative responsibility is not enough, therefore, the Government proposes to complement the new Penal Code articles. These articles provide for criminal penalties for violation of rights accounting for securities, manipulating the prices of the securities market, various obstacles and unlawful restriction of the rights of holders of securities.
Prosecution for the crimes provided for in cases where they involve the infliction of a major harm to citizens, organizations, or State or relate to revenue on a large scale. Thus, under a major injury (income) means the expense (income), the size of which exceeds 1 million rubles, particularly large - 2.5 million
Under the new law, violation of rights accounting for securities, resulting in major damage to citizens, organizations, or state, refers to a small gravity of crimes and punishable by a fine of 300 to 500 thousand rubles or imprisonment for up to 2 years with a fine a lesser amount or without penalty. The same crime, but by a group of persons acting in conspiracy, an organized group or caused harm to a particularly large amount, is considered a serious offense and is punishable by imprisonment for a term of 2 to 6 years.
Obstruction of or unlawful restriction of the rights of owners of securities also will be considered a small crime of gravity (a fine of up to 300 thousand rubles or imprisonment for up to 2 years). If the offense is committed by a group of persons by prior agreement or an organized group, it refers to crimes of medium gravity (fine of 300 to 500 thousand or imprisonment for up to 5 years).
Manipulation of prices in the securities market, according to the bill - a felony and is punishable by a fine of 500 thousand to 1 million rubles or imprisonment for a term of 2 to 6 years of age or if it is committed through the media - to imprisonment for a period of 5 to 7 years.
